Caution: watch for unfair suppliers!

COMINTRADE LLC feels compelled to warn market insiders of unfair suppliers who infringe a contract.

Company shipped the goods and indicated in invoice and shipping documents quantity as per Supplement to Contract, but actually less quantity was shipped. Short shipment was 7125 kg net for total amount about 9 thousand USD. Short shipment was confirmed by survey report, survey was made at port of arrival. Payment was made in due time, but the company delayed presentation of originals if shipping documents for custom clearance, it resulted with additional storage and demurrage expenses for total amount over 1 thousand USD.

Official claim presented to the company was ignored and the company ceased answering any letters or calls.

COMINTRADE LLC had nothing to do but to file an Arbitration Court complaint, we prevailed in arbitration.

Original Herbs for Import and Export, Египет.

Address: Baghous, El Fayoum, Egypt.

Company signed a Contract in July 2022 for shipment in September 2022 of 40’ container with sun dried herbs and cumin seeds. By the time of shipment price for cumin seeds increased in Egypt and the company refused to fulfil the Contract and didn’t even offer to reconsider the price. Just ceased answering our emails.

Company confirmed order for delivery of 40’ container with sun dried dill tips. But within some days after confirmation of the order refused to carry it out, having alluded to some letter allegedly received from Egyptian Embassy in Moscow, where it was said about cases built against COMINTRADE LLC. The Company refused to convey more detailed information and just notified COMINTRADE LLC that the order will not be carried out. Meanwhile in point of fact no cases were built against COMINTRADE LLC.

Company has signed a Contract for delivery of 1×40’FCL (25 mt) of pimento whole. Within a specified deadline the goods were not shipped. The company was not replying inquiries and deviated from any contacts. Official claim was ignored.

JINXIANG JINXIYUAN FOOD CO., LTD., Китай.

Address: Jinyuan Avenue, Food Industrial Development Zone, Jinxiang County, Shandong Province, China. 

Company has signed long standing contract for delivery of 120 mt of dried garlic. When the price was stable or decreasing on the market the company was supplying the goods, but when the price increased the company stopped the shipments and refused to deliver last two containers at Contract price.
